Terms of Service

1. Agreement and eligibility

These Terms of Service ("Terms") are an agreement between you and the operator of imakeit.ai ("we," "us," or "our"). By accessing or using the websites, features, and services that link to these Terms (collectively, the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use it only with permission and supervision from a parent or legal guardian. If you use the Service for an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Service

The Service provides AI-powered image generation, image editing, downloads, and related account, history, credit, and payment features. Some features may be available to guests; others may require an account, credits, a purchase, or a subscription. The credit cost and available settings for a generation are shown before you submit it.

We may use third-party infrastructure and AI model providers to deliver the Service. References to third-party models or products identify compatible technology and do not imply that their owners sponsor, endorse, or are affiliated with imakeit.ai.

3. Accounts and security

You agree to provide accurate information, keep it current, and maintain the security of your sign-in credentials. You are responsible for activity under your account unless applicable law provides otherwise. Notify us promptly at support@imakeit.ai if you believe your account has been compromised.

You may not sell, transfer, share, or create accounts through automated means, impersonate another person, or use another person's account without permission. Free credits and promotions may be limited to one person, household, device, or payment method and may be withdrawn if obtained through abuse, fraud, or duplicate accounts.

4. Credits, subscriptions, and payments

Credits are a limited, non-transferable right to use eligible Service features. They have no cash value, cannot be resold or transferred, and are not a bank balance or stored-value account. We deduct the displayed credit amount when a generation is successfully submitted. If a generation fails because of a technical error, the credits used for that request are automatically returned.

• One-time credit-pack credits expire six months after the purchase date.
• Subscription credits are issued monthly and expire when the next monthly allowance is granted; unused subscription credits do not roll over.
• When credits have different expiration dates, we generally use those that expire soonest first.

Prices, plan benefits, billing intervals, and any applicable taxes are presented before purchase. Monthly subscriptions renew and are billed monthly; yearly subscriptions are billed upfront for the full year and renew yearly, unless canceled before the renewal date. You authorize our payment provider to charge the payment method you select for each purchase and recurring renewal.

We may change future prices, plan features, or credit costs. Changes do not alter a completed one-time purchase and will apply to subscription renewals only after any notice required by applicable law.

5. Cancellation and refunds

You may cancel a subscription at any time through an available subscription-management option or by contacting support. Cancellation stops future renewals; your plan benefits remain active through the end of the current paid billing period unless otherwise stated or required by law.

Purchases of credit packs, subscription periods already billed, and completed AI generations are generally non-refundable. If you experience a billing or technical problem, contact support@imakeit.ai. We review requests based on the circumstances. Nothing in these Terms limits refund, cancellation, or withdrawal rights that cannot legally be excluded.

6. Your content

You retain the rights you have in prompts, uploaded images, and other materials you submit to the Service ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and modify User Content only as reasonably needed to provide, maintain, and secure the Service, comply with law, and enforce these Terms. We do not use your prompts, uploaded images, or Outputs to train AI models. This license ends when the content is deleted from our systems, subject to reasonable technical retention and legal requirements described in our Privacy Policy.

You represent that you have all rights, licenses, permissions, and consents needed for us to process User Content. This includes permission to use an identifiable person's image or likeness where required. You are responsible for User Content and for the instructions you provide to the Service.

7. Generated content

As between you and imakeit.ai, and to the extent permitted by applicable law, you may use images generated for you by the Service ("Outputs") for personal or commercial projects. We do not claim ownership of your Outputs.

AI systems may produce inaccurate, unexpected, similar, or identical results for different users. Outputs may not be unique or eligible for intellectual-property protection. We do not guarantee that an Output is accurate, non-infringing, or suitable for a particular use. You must review Outputs and are responsible for how you use, publish, or distribute them, including clearing any third-party copyrights, trademarks, privacy, publicity, or other rights.

8. Acceptable use

You may not use or attempt to use the Service to create, upload, process, or distribute:

• Child sexual abuse material, sexualized depictions of minors, or content that exploits or endangers children.
• Pornographic, sexually explicit, non-consensual intimate, or exploitative content, whether real or AI-generated.
• Content that promotes hatred, harassment, abuse, discrimination, self-harm, graphic violence, or credible threats of harm.
• Content that infringes intellectual property, privacy, publicity, confidentiality, or other rights.
• Fraudulent, deceptive, defamatory, unlawful, or malicious content, including impersonation, scams, malware, or material intended to mislead people about consequential matters.

You also may not interfere with the Service; probe or bypass access controls, rate limits, or safety measures; gain unauthorized access to systems or accounts; scrape or use the Service through unauthorized automation; reverse engineer the Service except where the law expressly permits it; or use the Service in violation of applicable law.

We may refuse a request, remove or restrict content, limit features, or suspend accounts when we reasonably believe these Terms have been violated or when necessary to address legal, safety, security, or abuse risks. We may report conduct to authorities when required by law.

9. Our intellectual property

The Service, including its software, interface, branding, design, documentation, and original site content, is owned by us or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose. These Terms do not grant you rights to our trademarks, source code, or other proprietary materials.

If you voluntarily send feedback, you allow us to use it without restriction or compensation, but you are not required to provide feedback.

10. Third-party services

The Service may rely on or link to third-party payment, authentication, hosting, analytics, storage, and AI inference services. Their products may be governed by separate terms and privacy policies. We are not responsible for third-party services outside our control, but our handling of personal information remains subject to our Privacy Policy.

11. Changes and availability

We may add, change, limit, suspend, or discontinue Service features, models, plans, or availability. We do not promise that the Service, a particular AI model, or stored generation history will always be available. Where reasonably practical, we will provide notice of material changes that significantly reduce a paid feature.

12. Suspension and termination

You may stop using the Service at any time. We may restrict, suspend, or terminate access if you violate these Terms, pose a legal or security risk, fail to pay amounts due, abuse free credits or promotions, or if continued access could harm us, our users, or others. When circumstances permit, we may give notice and an opportunity to remedy the issue.

On termination, your right to use the Service ends. Terms that by their nature should continue—including provisions on ownership, payment obligations, disclaimers, liability, and general terms—will survive.

13. Disclaimers

To the fullest extent permitted by law, the Service and all Outputs are provided "as is" and "as available." We disclaim all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or secure availability. We do not guarantee that the Service will meet your requirements or that defects or errors will be corrected.

14. Limitation of liability

To the fullest extent permitted by law, imakeit.ai and its operators, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, business opportunities, or service interruption, arising from or related to the Service or these Terms.

15. General terms

We may update these Terms from time to time. We will post the revised Terms here and change the "Last updated" date. For material changes, we may provide additional notice where required by law. Unless otherwise stated, updated Terms apply when posted. Your continued use of the Service after they take effect means you accept them.
